IP E-Game Venture Inc.’s Quarterly Report: Proof of Local Exclusivity for NBA 2K13?

TPC member harl4444 has uncovered IP E-Game Ventures, Inc.’s quarterly report to shareholders for the period which ended in September 30th, 2012. The report was released via the Philippine Stock Exchange website on November 14th, 2012. According to the said report, Epicsoft Asia is the entity that granted X-Play the exclusive rights to market and distribute the game in Philippine shores.

One of themost important statements from the report is “The Licensors granted the Group the exclusive right to market and distribute the games within Philippine territory.” The statement used “licensors” (plural) implying that all of the licensors listed in the table (Epicsoft included) granted  X-Play exclusive rights. The report also details that the NBA 2K13 distributing and marketing license took effect on September 18, 2012, with the term being a one-time purchase contract; and with X-Play paying a one-time license fee.

What is still missing however is the formal contract between Take 2 and X-Play to prove that Take 2 itself recognizes X-Play as the exclusive Philippine distributor of NBA 2K13. As mentioned by X-Play before, “Take 2 Interactive recognizes X-Play as the exclusive distributor of the NBA 2k13 games in all platforms in the Philippines“.

The report also confirms that X-Play has the exclusive rights for both NBA 2K Online and NBA 2K Social Web.


It should be noted that Epicsoft Asia is identified as the licensor for NBA 2K13 and not NBA 2K13’s publisher, 2K Sports/Take 2. This piece of information stands out more because the licensor for the other NBA 2K properties in the list (2K online and 2K Social web) is Take 2 International; and because X-Play themselves has said that Take 2 recognizes X-Play as the official distributor of NBA 2K13. Additionally, the licensor for World of Warcraft, Starcraft, and Diablo products are the games’ actual publisher, Blizzard Entertainment International.

This begs the question, why is Epicsoft and not Take 2, the licensor for one of Take 2’s biggest products?

Looking at Epicsoft’s website and Facebook page, it can be inferred that Epicsoft is a distributor of games in the Asian/Southeast Asian region. Whether Take 2 has authorized Epicsoft to grant X-Play the local exclusivity license is not known at this time. One possibility is that Epicsoft’s deal with X-Play only meant that Epicsoft will not distribute NBA 2K13 to any other Philippine  entities aside from X-Play. This could also mean that Datablitz got their NBA 2K13 stocks from a different distributor. Still, all of this just speculation and nothing has been confirmed.

It should also be mentioned that in the same report, under the 2012 financial highlights section, only the agreement for NBA 2K social is listed (see below). One would think that an agreement for local exclusivity for NBA 2K13, the biggest Basketball game on the planet would also be reported to shareholders as a financial highlight.
